 An uncontested divorce is a divorce where both spouses agree to the divorce, so there’s no need for a trial or lengthy court battles.  

The divorce is initiated by one spouse alone and is best suited for cases where no other claims—like child support, custody, or property division—are being made.

• Filed by one spouse (known as the applicant)

• The other spouse is served with the application and has a chance to respond

• Typically used when there’s no disagreement, but one spouse takes the lead in filing

A joint divorce in Ontario is ideal for spouses who mutually agree to end their marriage and have resolved all related matters.

• Filed together by both spouse

• No service required, as both parties sign and file the documents

• Usually faster and more cost-effective due to mutual consent

Before you start

• Do you have your original marriage certificate?

• Have you been separated for at least one year?

• Have you (or your ex) mainly lived in Ontario for at least one year?

FEE: $1,235.00 (This amount includes the court's mandatory filing fees.)

Note:

The above services do not include the Certificate of Divorce. The court does not send you a divorce certificate unless you request one and pay $25 for it once the divorce is final. You cannot request or pay for a divorce certificate in advance. You are not required to obtain a divorce certificate, except when you wish to remarry.
